The ACLU confirmed its latest victory in Illinois when Judge Hyman approved its settlement agreement with the Illinois Department of Public Health regarding the Department's prior policy of mandating gender reassignment surgery before it would consider reissuing changed birth certificates reflecting the applicant's new gender. Arguing that risk remained even after the IDPH changed its policy to dovetail to the ACLU's legal challenge, the ACLU's settlement permanently changes the legal landscape for any resident of Illinois that wishes to change their birth certificate's gender marking, without invasive surgery, as part of their gender transition. The ACLU notes that not all transgendered individuals want or need surgery as part of their gender transition and therefore the requirement was unnecessarily intrusive.
